Read this article for good perspective on Holder’s decision to try the 9/11 suspects in federal court in New York, especially if you don’t agree with it.

  1. Do “The Right’s nonsensical agruements” really offer much perspective here? I didn’t find much insight in the article - to argue Eric Holder must be correct in descision just because some right-wingers are hypocrites is weak at best. What I would like to know is why the big push to bring these trials into a civilian court?

    I understand the controversy surrounding the Guantanemo Military Commisions, but why not demand court-martial proceedings? It grants identical rights to defendants as civilian court, does it not? Khalid Sheikh Mohammed is accused of planning/participating in the attack against the United States unseen since World War II. Ordered and subsidized by Al Quaeda (a military organization by the way) this attack prompted open-ended military conflict around the world in all directions. He was captured by Pakistan military intelligence and turned over to the US military. How is he not a POW and how can it be argued this is purely a civilain matter?

    So, why make it a point to remove this responsibility from the military completely when the gross outcome will likely be the same no matter what? The article speaks of sacrificing legal principle in favor of political symbolism… Can it really be said that the oppertunity to drag Bush’s policies through the courts in the most provocative way possible while attached to the world wide spotlight of 9/11 trials was not a factor or influence in the decision? Or to “make a satement” regarding civilian court competancy is in no way meant to imply ineptitude in our military legal principle? Were justice and public safety the top concerns in the decision making process that is argued to be free of political influence?
